Job Cloud Portal Terms and Conditions

1. Introduction
Welcome to Job Cloud Portal (“Job Cloud Portal”, “we”, “us”, or “our”).
These Terms and Conditions (“Terms”) govern your access to and use of the Job Cloud Portal website, platform and related services. By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must discontinue use of the Platform immediately.
2. Definitions
For the purposes of these Terms:
Platform means the Job Cloud Portal website and all related services.
User means any individual or organisation accessing or using the Platform.
Job Seeker means a User seeking employment opportunities.
Employer means any individual or organisation advertising employment opportunities or reviewing applications.
Recruiter means any individual or organisation recruiting on behalf of an employer.
Curated Vacancy means a vacancy published by Job Cloud Portal that has been sourced from a publicly available employer careers page or another publicly accessible recruitment source.
3. Eligibility
To use the Platform, you must:
Be at least 18 years of age.
Have the legal capacity to enter into binding agreements.
Comply with all applicable laws of the Republic of South Africa.
4. User Accounts
Users agree to:
Provide accurate, complete and up-to-date information.
Keep login credentials confidential.
Notify Job Cloud Portal immediately of any unauthorised use of their account.
Accept responsibility for all activity occurring under their account.
Job Cloud Portal reserves the right to suspend, restrict or terminate accounts where these Terms are breached or unlawful activity is suspected.
5. Platform Services
Job Cloud Portal provides an online employment marketplace connecting employers, recruiters and job seekers.
Services may include:
Job advertising
Employer profiles
Candidate profiles
CV uploads
Job applications
Recruitment-related communications
Candidate search functionality
Curated job listings
Job Cloud Portal facilitates recruitment but is not an employment agency and does not guarantee employment, interviews, hiring decisions or recruitment outcomes.
6. Curated Job Listings
Job Cloud Portal may publish employment opportunities sourced from publicly available employer career pages or other publicly accessible recruitment sources.
Unless expressly stated otherwise:
Job Cloud Portal is not the recruiting employer.
Job Cloud Portal does not act as an agent or representative of the employer.
Vacancy information may be summarised, reformatted or adapted for consistency and readability.
Users should always refer to the employer’s official recruitment page for complete vacancy information and application instructions.
Applications for curated vacancies must be submitted through the employer’s designated application process unless otherwise indicated.
If an employer or authorised representative wishes for a curated vacancy to be amended or removed from the Platform, they may contact Job Cloud Portal using the contact details provided in these Terms.
7. Employer Responsibilities
Employers agree to:
Advertise only genuine employment opportunities.
Ensure vacancies comply with applicable labour and employment legislation.
Provide accurate and truthful vacancy information.
Ensure they have authority to advertise each vacancy.
Refrain from posting misleading, discriminatory or unlawful advertisements.
Employers remain solely responsible for the content and legality of their job advertisements.
8. Job Seeker Responsibilities
Job Seekers agree to:
Provide truthful and accurate information.
Upload only documents they own or have permission to use.
Keep their profiles current.
Use the Platform lawfully and responsibly.
9. Prohibited Conduct
Users may not:
Provide false or misleading information.
Impersonate another individual or organisation.
Upload malicious software or harmful code.
Attempt unauthorised access to the Platform.
Interfere with the security or operation of the Platform.
Use bots, scraping tools or automated software to copy or collect Platform content without prior written permission.
Publish unlawful, offensive, fraudulent or discriminatory content.
Misuse personal information obtained through the Platform.
10. Privacy and Data Protection
Job Cloud Portal processes personal information in accordance with applicable South African data protection legislation, including the Protection of Personal Information Act, 2013 (“POPIA”).
By using the Platform, Users consent to the processing of personal information necessary to provide recruitment-related services.

11. Intellectual Property
All Platform content, including branding, logos, software, graphics, website design and original content, remains the property of Job Cloud Portal unless otherwise stated.
Users retain ownership of the content they upload but grant Job Cloud Portal a non-exclusive, worldwide, royalty-free licence to use, display and process such content solely for operating the Platform and providing recruitment-related services.
Users may not reproduce, distribute, modify or commercially exploit Platform content without prior written permission, except where permitted by law.
12. Third-Party Websites
The Platform may contain links to third-party websites.
Job Cloud Portal is not responsible for the content, availability, security or privacy practices of third-party websites. Users access such websites at their own risk.
13. Accuracy of Information
While Job Cloud Portal takes reasonable steps to ensure information published on the Platform is accurate at the time of publication, we do not guarantee that:
Vacancies remain available.
Information is complete or up to date.
Employers will continue with recruitment.
Users will receive interviews or employment.
Vacancies may be amended or withdrawn without notice.
14. Applications
Where applications are submitted directly to employers, Job Cloud Portal is not responsible for:
Recruitment processes.
Communication from employers.
Interview invitations.
Hiring decisions.
Employment contracts or employment relationships.
15. Payment Terms
Some Platform services may become subject to fees.
Where fees apply, pricing, payment methods and applicable terms will be published separately before any charges become payable.
16. Disclaimer
The Platform is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Job Cloud Portal makes no warranties regarding the availability, accuracy, reliability or suitability of the Platform or any vacancy published on it.
17. Limitation of Liability
To the maximum extent permitted by law, Job Cloud Portal shall not be liable for any indirect, incidental, consequential or special damages, including loss of profits, income, business opportunities, employment opportunities or data arising from the use of the Platform.
18. Fraud Prevention
Job Cloud Portal reserves the right to investigate and remove any vacancy, employer account or user account suspected of fraudulent, misleading or unlawful activity.
Job seekers should never pay money to secure employment unless required by law or by a recognised professional registration process.
Users are encouraged to report suspicious vacancies immediately.
19. Service Availability
While we aim to provide continuous access to the Platform, we do not guarantee uninterrupted availability.
The Platform may be unavailable due to maintenance, upgrades, technical issues or circumstances beyond our reasonable control.
20. Indemnity
Users agree to indemnify and hold harmless Job Cloud Portal, its owners, employees and affiliates from any claims, damages, liabilities, costs or expenses arising from their misuse of the Platform or breach of these Terms.
21. Termination
Job Cloud Portal reserves the right to suspend or terminate any account, without prior notice, where these Terms are breached or unlawful activity is suspected.
22. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
23. Dispute Resolution
The parties agree to attempt to resolve disputes amicably before commencing legal proceedings.
Where disputes cannot be resolved, they shall be subject to the jurisdiction of the courts of the Republic of South Africa.
24. Force Majeure
Job Cloud Portal shall not be liable for delays or failures resulting from events beyond its reasonable control.
25. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
26. Entire Agreement
These Terms constitute the entire agreement between Job Cloud Portal and its Users regarding use of the Platform.
27. Changes to These Terms
Job Cloud Portal may amend these Terms from time to time.
Updated Terms will be published on the Platform with the revised effective date. Continued use of the Platform after such publication constitutes acceptance of the updated Terms.
29. Content Removal Requests
Job Cloud Portal respects the intellectual property rights of employers, recruiters and other third parties.
Where vacancies are sourced from publicly available employer career pages or other publicly accessible recruitment sources, Job Cloud Portal may summarise, reformat or reference such vacancies for informational purposes and will, where applicable, direct users to the employer’s official application process.
If you are an employer, recruiter or authorised representative and believe that content published on the Platform should be removed or amended, please contact us at info@jobcloudportal.co.za with sufficient details of your request.
Upon receiving a legitimate request, Job Cloud Portal will review the matter promptly and, where appropriate, remove or amend the relevant content within a reasonable period.
